Yup - typical Ofcom - O2 fail to make the grade so Ofcom don't do anything - all they do is posture 'cos they know that O2 will have hit the target before the "new" deadline.
Can we please have a directive from the government that this practice is acceptable and I will point it out to the Local Authority the next time one of its parking attendants slaps a ticket on my car - if I tell them when I'm going to leave the parking space they can let me off.
